Disclaimer and Limitation of Liability

This Disclaimer and Limitation of Liability applies to ForceMap by Ultimate Golf Education ("ForceMap"), our websites, software, subscriptions, licensing services, support, documentation and related services.

ForceMap is provided by Ultimate Golf Performance Pty Ltd, trading as Ultimate Golf Education ("UGE", "we", "us" or "our").

This document should be read with our Terms of Service, End User Licence Agreement, Privacy Policy, Refund Policy and Acceptable Use Policy.

1. Professional software only

ForceMap is professional software for golf coaches, sports performance professionals and researchers. It is intended to support performance analysis and coaching workflows.

ForceMap does not replace professional judgement, appropriate training, safe coaching practices, hardware expertise, research ethics, privacy compliance or independent verification.

2. Not medical advice

ForceMap is not a medical device and does not provide medical advice.

ForceMap must not be used for:

  • medical diagnosis;
  • injury diagnosis;
  • treatment decisions;
  • rehabilitation decisions;
  • clinical monitoring;
  • patient care;
  • emergency decisions;
  • any purpose that requires regulated medical device approval.

If a person needs medical, physiotherapy, rehabilitation or health advice, they should consult an appropriately qualified health professional.

3. Coaching decisions remain your responsibility

All coaching, training, athlete management, performance, research and business decisions remain the responsibility of the user.

You are responsible for:

  • interpreting ForceMap outputs;
  • confirming whether outputs are accurate and complete;
  • checking hardware setup and calibration;
  • checking OCR, capture, calculation and export results;
  • considering athlete readiness, safety and context;
  • obtaining any required consent;
  • deciding whether and how to apply any coaching intervention;
  • complying with professional, legal, ethical and research obligations.

4. Hardware and environment disclaimer

ForceMap may interact with force plate, pressure mapping and related hardware. Results may be affected by:

  • hardware model and firmware;
  • drivers and operating system settings;
  • calibration and setup;
  • screen resolution and display scaling;
  • capture quality;
  • OCR quality;
  • data extraction or conversion errors;
  • user workflow;
  • physical environment;
  • third-party vendor changes;
  • data availability and hardware limitations.

UGE does not control third-party hardware and is not responsible for hardware defects, incorrect hardware setup, unsafe physical use, third-party driver issues or third-party vendor changes.

5. Output accuracy

ForceMap is designed to assist analysis, but no software output should be treated as infallible. You should independently verify outputs before relying on them.

UGE does not guarantee that ForceMap outputs, diagnostics, calculations, exports, reports or screenshots will be error-free, complete, current or suitable for every purpose.

Incorrect OCR, capture, calculation, calibration, charting, export or reporting output is a known risk of technical performance software. Users must apply professional judgement and independent checks before making decisions.

6. No guarantee of uninterrupted service

ForceMap, licensing services, downloads, support systems, websites and third-party integrations may be interrupted by maintenance, updates, outages, network issues, payment provider issues, licensing provider issues, security events or circumstances outside our control.

Hosted services may depend on providers such as Railway, Stripe, Keygen, email delivery providers and other infrastructure providers. UGE does not guarantee uninterrupted availability of those third-party services.

7. Consumer rights

Nothing in this document excludes, restricts or modifies rights that cannot lawfully be excluded, restricted or modified, including applicable consumer guarantees and statutory warranties.

Where a mandatory law gives you rights or remedies, those rights or remedies apply despite anything inconsistent in this document.

8. Disclaimer of warranties

To the maximum extent permitted by law, ForceMap and related services are provided "as is" and "as available". UGE disclaims all warranties not expressly stated in writing, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, compatibility and uninterrupted operation.

9. Limitation of liability

To the maximum extent permitted by law, UGE is not liable for:

  • indirect, incidental, special, exemplary, punitive or consequential loss;
  • loss of profit, revenue, business, goodwill, opportunity, expected savings or reputation;
  • loss, corruption or interruption of data;
  • hardware failure or third-party hardware issues;
  • third-party service failures, including payment, licensing, hosting, email or analytics providers;
  • incorrect setup, calibration, interpretation or use;
  • incorrect OCR, capture, force plate, pressure mapping, calculation, chart, report, export or diagnostic output;
  • service outages, interrupted downloads, licence validation outages or delayed support;
  • support bundle contents submitted by users;
  • future AI-assisted outputs, if AI features are introduced;
  • coaching, training, athlete management, research or professional decisions;
  • medical, clinical, injury, rehabilitation or health-related decisions;
  • unauthorised access caused by your failure to secure devices, accounts, files or credentials.

To the maximum extent permitted by law, UGE's total liability arising out of or relating to ForceMap is limited to the greater of:

  • the fees you paid to UGE for ForceMap in the 12 months before the event giving rise to the claim; or
  • AUD 100.

This limitation applies whether the claim is based in contract, tort, negligence, statute, equity or any other legal theory, to the extent permitted by law.

10. No exclusion where prohibited

Nothing in this document excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
