This Privacy Policy explains how Ultimate Golf Performance Pty Ltd, trading as Ultimate Golf Education ("UGE", "we", "us" or "our"), collects, uses, stores and shares personal information in connection with ForceMap by Ultimate Golf Education ("ForceMap"), our websites, software licensing, support, billing and related services.

ForceMap is commercial Windows desktop software for golf coaches, sports performance professionals and researchers. ForceMap is not a medical device, does not provide medical advice, and is not intended to collect health records or medical information.

For privacy laws that use the terms "controller", "business" or similar, UGE is generally the organisation that decides why and how personal information is handled for ForceMap accounts, licences, support and product operations.

If a customer uses ForceMap with their own players, athletes, students, clients or research participants, that customer is responsible for how they collect, use, disclose and store information about those people.

2. Information we collect

We collect only the information reasonably needed to provide, secure, licence, support and improve ForceMap.

Account and contact information

We may collect:

  • name;
  • email address;
  • business, organisation or coaching studio name;
  • country, region or time zone;
  • support contact details;
  • subscription or account status.

Licensing information

ForceMap licensing is managed using Keygen and related licensing systems. We may collect:

  • licence ID or entitlement details;
  • subscription plan;
  • activation status;
  • device activation count;
  • licence validation events;
  • licence suspension, expiry or cancellation status.

Support bundles must not include full licence keys. If a support file accidentally contains sensitive licensing information, we may delete, redact or restrict access to that information.

Device and application information

ForceMap may collect or generate:

  • device identifiers used for licensing and anti-abuse checks;
  • operating system version;
  • application version;
  • installation, activation and update information;
  • hardware configuration information needed for support, such as connected force plate or pressure mapping device details, driver state, display settings and calibration context;
  • diagnostic logs;
  • crash logs;
  • error reports;
  • support reports submitted by the user;
  • software usage information, such as feature usage, activation events or technical performance information;
  • OCR, screen capture or calculation diagnostic context where needed to troubleshoot ForceMap output, provided that users should not include health records or unnecessary personal information.

Support bundles and diagnostic reports

ForceMap may allow users to generate support bundles, diagnostic reports, screenshots, logs or other troubleshooting files locally on their Windows device. These files are not automatically reviewed by UGE unless the user sends them to us or uploads them through a support channel.

Support bundles and diagnostic reports may include:

  • application version, operating system information and error messages;
  • licensing status and partial licensing identifiers;
  • local configuration settings;
  • OCR or screen capture diagnostics;
  • hardware setup, calibration and compatibility information;
  • screenshots or exported files selected by the user.

Users are responsible for reviewing support materials before sending them to us. Users must not send passwords, full licence keys, payment card details, health records, medical information or unnecessary personal information.

Payment and billing information

Payments are handled by Stripe. We may receive limited billing information from Stripe, such as:

  • customer ID;
  • subscription status;
  • payment status;
  • billing email;
  • billing country;
  • invoice and receipt references;
  • last four digits or card brand if provided by Stripe for receipt or account management purposes.

We do not collect or store credit card numbers or full payment card details.

Website information

When you visit our websites, we may collect:

  • IP address;
  • browser and device information;
  • pages visited;
  • referral source;
  • cookie preferences;
  • form submissions;
  • download or checkout activity.

3. Information we do not intentionally collect

ForceMap is designed so that we do not intentionally collect:

  • credit card numbers;
  • full payment card details;
  • passwords;
  • full licence keys in support bundles;
  • health records;
  • medical information;
  • diagnosis, treatment or clinical notes;
  • information that ForceMap needs to be treated as a medical device.

Users must not submit medical records, patient records, diagnosis notes or regulated health information to us unless we have expressly agreed in writing and appropriate legal safeguards are in place.

4. How we use personal information

We use personal information to:

  • create and manage ForceMap accounts;
  • process subscriptions and billing through Stripe;
  • issue, validate, suspend, reactivate and terminate licences;
  • provide software downloads and updates;
  • provide customer support;
  • investigate crashes, errors, bugs and support requests;
  • investigate incorrect OCR results, incorrect calculations, hardware compatibility issues and diagnostic reports;
  • improve software quality, reliability and user experience;
  • protect ForceMap against fraud, piracy, misuse, unauthorised redistribution and security threats;
  • detect, investigate and respond to security incidents;
  • send operational emails, such as receipts, licence emails, support replies and product notices;
  • send marketing communications where permitted by law or with consent where required;
  • comply with legal, tax, accounting and regulatory obligations;
  • enforce our Terms of Service, EULA and Acceptable Use Policy.

6. Coaching, research and performance data

ForceMap may help users view, export or interpret golf force plate and pressure mapping information. Coaching, training, research and performance decisions remain the sole responsibility of the user and their organisation.

ForceMap does not provide medical advice, clinical diagnosis, treatment recommendations, injury diagnosis or rehabilitation instructions. Users are responsible for obtaining appropriate consent and permissions from any players, athletes, students, clients or research participants whose information they collect or process.

7. How we share information

We may share personal information with trusted service providers that help us operate ForceMap, including:

  • Stripe for payments, subscriptions, invoices and billing;
  • Keygen for software licensing, device activations and entitlement checks;
  • Railway or similar hosting providers for hosted licensing, download, email or account services;
  • email delivery providers for transactional messages;
  • hosting, database, security and infrastructure providers;
  • analytics, diagnostics or crash reporting providers if enabled;
  • professional advisers such as lawyers, accountants and insurers;
  • regulators, courts or law enforcement where required by law.

We do not sell personal information. We do not share personal information for cross-context behavioural advertising unless we clearly disclose that practice and provide required opt-out rights.

8. International transfers

UGE is based in Australia and sells ForceMap globally. Personal information may be processed in Australia, the United States, the European Economic Area, the United Kingdom, Japan, South Korea and other countries where we or our service providers operate.

Where required, we use appropriate safeguards for international transfers. These may include data processing agreements, standard contractual clauses, adequacy decisions, transfer impact assessments and other legally recognised safeguards.

9. Data retention

We keep personal information only for as long as reasonably needed for the purposes described in this Privacy Policy, unless a longer period is required by law.

Our general retention approach is explained in our Data Retention Policy. In summary:

  • active account and licence records are retained while the account or licence is active;
  • billing and tax records may be retained for the period required by applicable law;
  • support records are retained for a reasonable support, quality and dispute resolution period;
  • diagnostic and crash information is retained only as long as needed for security, reliability and product improvement;
  • deleted or cancelled account information may remain in backups for a limited period before being overwritten.

10. Security

We use reasonable technical and organisational safeguards designed to protect personal information. These may include access controls, encryption where appropriate, least-privilege access, logging, secure service providers, support bundle redaction and internal data handling procedures.

No method of transmission or storage is completely secure. Users are responsible for securing their own devices, email accounts, licence access and exported ForceMap files.

If we become aware of a security incident involving personal information, we will assess it and provide notifications where required by applicable law. This may include notifying affected individuals, regulators or service providers where a notification threshold is met.

11. Your privacy rights

Depending on where you live, you may have rights to:

  • access personal information we hold about you;
  • correct inaccurate personal information;
  • request deletion;
  • object to or restrict certain processing;
  • request data portability;
  • withdraw consent where processing is based on consent;
  • opt out of marketing;

California

California residents may have rights under the California Consumer Privacy Act, as amended, including rights to know, access, delete, correct and opt out of certain selling or sharing of personal information. We do not sell personal information. We do not knowingly sell or share personal information of consumers under 16.

Japan

Users in Japan may have rights under the Act on the Protection of Personal Information, including rights to request disclosure, correction, deletion or suspension of use in certain circumstances.

South Korea

Users in South Korea may have rights under the Personal Information Protection Act, including rights to access, correct, delete or suspend processing of personal information in certain circumstances.

12. Marketing communications

You can unsubscribe from marketing emails using the unsubscribe link in the email or by contacting us. We may still send transactional or operational messages, such as licence, billing, security, support and product notices.

13. Automated licence decisions

ForceMap may automatically validate licences and device activations. This may result in access being allowed, denied, limited, suspended or expired based on subscription status, activation limits, payment status, misuse signals or licence rules.

14. Future AI features

ForceMap does not currently need to use artificial intelligence to provide medical advice or healthcare services. If we introduce AI-assisted features in the future, we will update our disclosures where required. AI-assisted features, if introduced, must not be treated as medical advice, clinical diagnosis or a substitute for professional judgement.

15. Children

ForceMap is intended for professional and business use. It is not directed to children. Users must not allow children to submit personal information to us directly without appropriate authority and legal compliance.

16. Changes to this policy

We may update this Privacy Policy from time to time. We will update the effective date when we make changes. If changes are material, we will provide reasonable notice through the website, email or the software.
