End User Licence Agreement

This End User Licence Agreement ("EULA") governs your installation and use of ForceMap by Ultimate Golf Education ("ForceMap"). ForceMap is licensed, not sold.

ForceMap is provided by Ultimate Golf Performance Pty Ltd, trading as Ultimate Golf Education ("UGE", "we", "us" or "our").

By installing, activating, accessing or using ForceMap, you agree to this EULA. If you do not agree, do not install or use ForceMap.

1. Software covered

This EULA applies to:

  • the ForceMap Windows desktop application;
  • installers, updates, patches and new versions;
  • software components and libraries supplied with ForceMap;
  • documentation, templates and support materials;
  • licence activation and validation features;
  • local diagnostic, support bundle, OCR, capture and export features.

2. Licence grant

Subject to your compliance with this EULA, the Terms of Service and your subscription or purchase terms, UGE grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use ForceMap for your professional, business, coaching, education or research purposes.

Your licence is limited by your plan, seat count, device activation limits, subscription status and any written order terms.

3. Licence restrictions

You must not:

  • copy ForceMap except as reasonably necessary for installation or backup;
  • sell, resell, rent, lease, lend, sublicense, distribute, publish or make ForceMap available to any unauthorised person;
  • share licence credentials, activation credentials or licence access outside your authorised users;
  • bypass, disable, interfere with or remove licence checks, activation checks, technical controls or copy protection;
  • reverse engineer, decompile, disassemble or attempt to derive source code, algorithms, data structures or underlying ideas except to the extent applicable law permits despite this restriction;
  • modify, adapt, translate or create derivative works from ForceMap;
  • distribute, mirror, upload, publish or share ForceMap installers, update packages, licence files, activation links or download links without written permission from UGE;
  • use automation, virtualisation, cloning, device spoofing, network relaying or account pooling to exceed licence limits;
  • use ForceMap to build, train, benchmark or improve a competing product or service;
  • remove copyright, trademark, licence, proprietary or legal notices;
  • use ForceMap for unlawful, unsafe, misleading or prohibited purposes;
  • use ForceMap as a medical device or as a substitute for medical, clinical, rehabilitation or health advice.

4. Authorised users and devices

Only authorised users may use ForceMap. You are responsible for all use under your licence, account, subscription, devices and activation credentials.

Device identifiers may be used to enforce licence limits and prevent misuse. If you need a device activation reset, contact support. We may approve or reject reset requests based on plan limits, misuse signals and reasonable operational needs.

5. Ownership

UGE and its licensors own all rights, title and interest in ForceMap, including software code, design, user interface, workflows, calculations, templates, documentation, trademarks and related intellectual property.

This EULA does not transfer ownership of ForceMap to you.

6. User files and outputs

You own the files, reports, exports, screenshots and other materials you create using ForceMap, subject to UGE's ownership of the software and embedded proprietary materials.

You are responsible for securing, backing up, reviewing and lawfully using your files and outputs.

ForceMap may create local files, cached data, settings, exports, diagnostics and support bundles on your device. You are responsible for protecting local data, deleting local data when appropriate, and preventing unauthorised access to exported or diagnostic files.

7. Updates

UGE may provide updates, patches, fixes or new versions. Some updates may be required for security, licensing, compatibility, support or continued use.

We may stop supporting older versions. We are not responsible for issues caused by unsupported versions, outdated hardware, unsupported drivers or unsupported operating systems.

8. Third-party components

ForceMap may include or interact with third-party components, libraries, services, drivers or hardware. Third-party components may be subject to separate terms or open-source licences. To the extent required, those separate terms apply to the relevant components.

9. Hardware and environment

ForceMap may depend on compatible Windows versions, hardware, drivers, firmware, force plate or pressure mapping systems, screen settings and local configuration.

You are responsible for obtaining, maintaining and safely operating compatible hardware and systems. We do not guarantee compatibility with every hardware model, firmware version, driver version or physical setup.

ForceMap outputs may be affected by force plate data quality, pressure mapping data quality, OCR accuracy, screen capture quality, calibration, display scaling, hardware setup, user workflow and third-party software. You must verify important outputs before relying on them.

10. No medical use

ForceMap is not a medical device and must not be used for medical diagnosis, treatment, injury diagnosis, rehabilitation decisions or clinical decision-making.

ForceMap outputs are performance and coaching tools only. Coaching, training, research and athlete management decisions remain the responsibility of the user.

11. Support reports and diagnostics

If you submit diagnostics, crash logs or support reports, you must not include passwords, full licence keys, health records, medical information or unnecessary personal information.

Support bundles are intended to exclude full licence keys. We may delete, redact or restrict access to sensitive information included by mistake.

By sending support bundles, diagnostic reports, screenshots, exports or other materials to UGE, you grant UGE a limited licence to use them for support, troubleshooting, software improvement, security investigation, licence enforcement and legal compliance.

12. Licence suspension and termination

UGE may suspend or terminate your licence if:

  • your subscription expires, is cancelled or is unpaid;
  • payment is reversed, charged back or disputed;
  • licence activation limits are exceeded;
  • we reasonably suspect licence sharing, piracy, unauthorised redistribution, fraud or misuse;
  • installers, download links, activation credentials or licence materials are shared outside the authorised scope;
  • you breach this EULA, the Terms of Service or Acceptable Use Policy;
  • continued access creates legal, security or operational risk.

On termination, you must stop using ForceMap and uninstall it from your devices unless mandatory law gives you a continuing right.

13. Audit and enforcement

We may use reasonable technical measures to verify licence compliance, activation status and device limits. We may investigate suspected misuse, piracy or unauthorised redistribution.

For enterprise or multi-user licences, we may request reasonable information needed to verify compliance. We will use commercially reasonable efforts to avoid unnecessary disruption.

14. Export control and sanctions

You must comply with applicable export control, sanctions and trade laws. You must not use, export or re-export ForceMap in violation of those laws.

15. Future AI-assisted features

If UGE introduces AI-assisted features in ForceMap, those features will be provided only as software assistance. Unless expressly stated in separate written terms, AI-assisted outputs will not be medical advice, clinical advice, legal advice or a substitute for professional judgement. UGE may require updated terms, notices or consent before enabling AI-assisted features.

16. Warranty disclaimer

To the maximum extent permitted by law, ForceMap is provided "as is" and "as available". UGE disclaims all warranties not expressly stated in this EULA, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted operation.

Nothing in this EULA excludes or limits warranties, consumer guarantees or rights that cannot lawfully be excluded.

17. Limitation of liability

To the maximum extent permitted by law, UGE is not liable for indirect, consequential, incidental, special, exemplary or punitive damages, including loss of profit, revenue, data, business, goodwill, opportunity or expected savings.

UGE is not liable for incorrect OCR outputs, incorrect force plate or pressure mapping calculations, calibration errors, hardware compatibility issues, third-party service outages, data corruption, lost exports, local device failures or coaching, training, research, athlete management or professional decisions made using ForceMap, except to the extent liability cannot lawfully be excluded.

To the maximum extent permitted by law, UGE's total liability arising out of or relating to ForceMap or this EULA is limited to the greater of:

  • the fees you paid to UGE for ForceMap in the 12 months before the event giving rise to the claim; or
  • AUD 100.

This limitation does not apply to liability that cannot be limited by law.

18. Consumer rights

Some jurisdictions give consumers rights that cannot be excluded, restricted or modified. This EULA applies only to the extent permitted by those laws.

19. Governing law

This EULA is governed by the laws of New South Wales, Australia, unless mandatory law in your location requires otherwise. Courts in New South Wales, Australia have non-exclusive jurisdiction.
