Terms of Service

These Terms of Service ("Terms") apply to your access to and use of ForceMap by Ultimate Golf Education ("ForceMap"), our websites, downloads, subscriptions, licensing services, support services and related services.

ForceMap is provided by Ultimate Golf Performance Pty Ltd, trading as Ultimate Golf Education ("UGE", "we", "us" or "our"). By purchasing, downloading, installing, accessing or using ForceMap, you agree to these Terms.

If you use ForceMap on behalf of a business, coaching studio, research organisation, university or other entity, you represent that you have authority to bind that entity.

1. ForceMap

ForceMap is Windows desktop software for golf coaches, sports performance professionals and researchers. It integrates with golf force plate and pressure mapping hardware and helps users view, analyse, export and manage performance-related information.

ForceMap is not a medical device, does not provide medical advice, and must not be used for clinical diagnosis, treatment, injury diagnosis or medical decision-making.

2. Relationship between these Terms and the EULA

These Terms govern the commercial relationship between you and UGE, including purchases, subscriptions, support, billing, websites and account services.

The End User Licence Agreement ("EULA") governs your licence to install and use the ForceMap software. If there is a conflict between these Terms and the EULA about software use, the EULA applies to the software use issue. These Terms continue to apply to billing, subscriptions, websites and services.

3. Accounts and eligibility

You must provide accurate account, billing and contact information. You are responsible for keeping your email address current because we may use it for licence, billing, support and legal notices.

You must not:

  • create accounts using false information;
  • impersonate another person or organisation;
  • use ForceMap in violation of law;
  • use ForceMap if you are prohibited from doing so by applicable sanctions, export control or trade laws.

4. Subscriptions and payment

ForceMap is sold globally through Stripe subscriptions unless we agree otherwise in writing.

By subscribing, you authorise Stripe or our payment provider to charge the applicable fees, taxes and renewal amounts for your selected plan. Subscription fees are charged in advance unless stated otherwise at checkout.

Prices, plan names, features, limits and billing periods may change. If we materially change your price for an active subscription, we will provide reasonable notice where required by law.

You are responsible for all taxes, duties and government charges that apply to your purchase, except taxes based on our income.

Subscription access is tied to the account, licence and plan purchased. Unless we agree otherwise in writing, subscriptions may not be shared across unrelated businesses, resold, transferred, pooled or used as a general access pass for unauthorised users.

5. Subscription cancellation

You may cancel your subscription using the cancellation process we make available, such as a Stripe customer portal, account page or support request.

Cancellation stops future renewal charges but does not automatically refund amounts already paid unless our Refund Policy or applicable law requires a refund.

Your licence may remain active until the end of the paid billing period unless your account is terminated or suspended for breach, misuse, chargeback, fraud or legal reasons.

6. Failed payments and chargebacks

If payment fails, we may retry the charge, notify you, suspend the licence, downgrade access, or terminate the subscription.

If you initiate a chargeback or payment dispute, we may suspend or terminate the related licence while the dispute is investigated. This does not limit any rights you have under applicable consumer law.

7. Trials, promotions and discounts

We may offer trials, promotions or discounts. Unless stated otherwise, promotional terms apply only for the promotional period and the subscription renews at the then-current price after that period.

You may not abuse trials, promotional codes or discounts by creating multiple accounts, using false information or bypassing eligibility limits.

8. Licence to use ForceMap

Subject to your compliance with these Terms, the EULA and payment obligations, we grant you a limited, revocable, non-exclusive, non-transferable licence to use ForceMap for your professional, business, coaching, education or research purposes.

Your licence is not a sale of the software. UGE and its licensors retain ownership of ForceMap and all related intellectual property.

You may not redistribute ForceMap installers, update packages, licence files, activation links or download links except as expressly authorised by UGE in writing. We may disable or rotate download links, licence credentials or activation credentials if we reasonably suspect unauthorised sharing or redistribution.

9. User responsibilities

You are responsible for:

  • using ForceMap only with appropriate hardware, systems and permissions;
  • ensuring that coaches, staff, researchers and other users are trained and competent;
  • obtaining consent from players, athletes, students, clients or research participants where required;
  • protecting exported files, screenshots, reports and local data;
  • making appropriate backups;
  • reviewing support bundles, diagnostics, screenshots and exported files before sending them to UGE or anyone else;
  • complying with privacy, employment, research, sport, consumer, health and professional rules that apply to your work;
  • independently verifying any outputs before relying on them.

10. Coaching decisions and no medical advice

ForceMap provides tools and information. It does not replace professional judgement.

All coaching, training, performance, research and athlete management decisions remain the responsibility of the user. You must not present ForceMap output as medical advice, diagnosis, treatment advice or injury assessment.

If a player, athlete, student or client requires medical, physiotherapy, rehabilitation or clinical advice, they should consult an appropriately qualified health professional.

ForceMap outputs may depend on OCR, screen capture, force plate data, pressure mapping data, calibration, hardware configuration, user workflow and third-party systems. You must independently verify important outputs before relying on them for coaching, training, research, publication or business decisions.

11. Support

We may provide support by email, helpdesk, documentation, remote guidance, software updates or other channels. Support scope, availability and response times may vary by plan.

Support reports and diagnostic logs should not include passwords, full licence keys, health records, medical information or other sensitive information.

If you send us support bundles, diagnostics, screenshots, exported files, descriptions, feedback or other materials, you grant us a limited licence to use those materials to provide support, troubleshoot issues, improve ForceMap, investigate security or licence issues, and protect our legal rights. You represent that you have the rights and permissions needed to send those materials to us.

12. Updates, changes and future AI-assisted features

We may provide updates, patches, new versions, feature changes, compatibility changes or security improvements. Some updates may be required for security, licensing, compatibility or continued use.

We may modify, discontinue or remove features where reasonably necessary, including for security, legal, technical, licensing or commercial reasons. We will use reasonable efforts to avoid unnecessary disruption to active subscribers.

If we introduce AI-assisted features in the future, those features will be subject to any additional notices, limits or terms we provide. Unless expressly stated in writing, AI-assisted outputs are software assistance only and must not be treated as medical advice, clinical advice, legal advice or a substitute for professional judgement.

13. Acceptable use

You must comply with our Acceptable Use Policy. Without limiting that policy, you must not:

  • reverse engineer, decompile or attempt to derive source code except to the extent applicable law permits despite this restriction;
  • modify, patch, tamper with, translate, adapt or create derivative works of ForceMap except as expressly permitted by UGE in writing;
  • copy, redistribute, resell, rent, lease, sublicense or make ForceMap, installers, updates, licence files, activation credentials or download links available to unauthorised users;
  • bypass licence checks, activation limits, payment controls or technical restrictions;
  • use ForceMap to create a competing product or service;
  • upload or transmit malware;
  • use ForceMap in a way that infringes intellectual property, privacy or other rights.

14. Intellectual property

ForceMap, the ForceMap name, software, user interface, workflows, calculations, designs, documentation, text, graphics, logos, trademarks, data structures and related materials are owned by UGE or its licensors and are protected by intellectual property laws.

You retain ownership of files, reports, exports and data you create using ForceMap, subject to our rights in the software itself.

If you give us feedback, suggestions or ideas, you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use them without restriction or compensation.

15. Third-party services and hardware

ForceMap may depend on third-party services, including Stripe, Keygen, email services, hosting providers, operating systems and hardware vendors.

ForceMap hosted services may be operated using providers such as Railway, Stripe, Keygen, email delivery providers and other infrastructure providers.

We are not responsible for third-party services or hardware that we do not control. Hardware compatibility may depend on drivers, firmware, operating system settings, physical setup, vendor changes and user configuration. Third-party service outages, API changes, billing provider issues, licence provider issues, hosting incidents or hardware vendor changes may affect ForceMap.

16. Suspension and termination

We may suspend or terminate access to ForceMap, licences, downloads, support or accounts if:

  • payment is overdue;
  • subscription is cancelled or expired;
  • licence limits are exceeded;
  • we reasonably suspect fraud, piracy, misuse, unauthorised redistribution or security risk;
  • you breach these Terms, the EULA or Acceptable Use Policy;
  • you share accounts, licences, activation credentials, installers or download links outside the authorised scope;
  • we are required to do so by law;
  • continued access could harm UGE, users, service providers or third parties.

Where reasonable, we will provide notice and an opportunity to resolve the issue. We may act immediately where the issue is urgent, unlawful, harmful or security-sensitive.

After termination, your right to use ForceMap ends and you must stop using the software except as permitted by law.

17. Consumer rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory warranty, refund right or other right that cannot lawfully be excluded.

In Australia, our goods and services may come with rights under the Australian Consumer Law. In the EU, UK, United States, Japan, South Korea and other places, local consumer protection laws may also apply. If these Terms conflict with mandatory consumer rights, those mandatory rights apply.

18. Disclaimers

To the maximum extent permitted by law, ForceMap is provided "as is" and "as available". We do not guarantee that ForceMap will be uninterrupted, error-free, compatible with every hardware setup, or suitable for every coaching, research or business purpose.

We do not warrant that ForceMap outputs will be complete, accurate or appropriate for any specific coaching, performance, research, commercial, legal or professional decision.

We do not warrant that OCR outputs, force plate calculations, pressure mapping calculations, exports, reports, charts, screenshots, diagnostic reports or future AI-assisted outputs will be error-free, complete or suitable for any particular decision.

19. Limitation of liability

To the maximum extent permitted by law, UGE is not liable for:

  • indirect, incidental, special, exemplary, punitive or consequential loss;
  • loss of profit, revenue, business, goodwill, opportunity or expected savings;
  • loss, corruption or interruption of data;
  • hardware failure, third-party service failure or internet failure;
  • incorrect OCR, calculation, capture, export or diagnostic output;
  • coaching, training, research, athlete management or professional decisions made by users;
  • medical, clinical, injury, rehabilitation or health-related decisions.

To the maximum extent permitted by law, our total liability arising out of or relating to ForceMap is limited to the greater of:

  • the fees you paid to UGE for ForceMap in the 12 months before the event giving rise to the claim; or
  • AUD 100.

This limitation does not apply to liability that cannot be limited by law.

20. Indemnity

If you are a business user, you agree to indemnify UGE against claims, losses, damages, liabilities and reasonable costs arising from:

  • your misuse of ForceMap;
  • your breach of these Terms, the EULA or Acceptable Use Policy;
  • your violation of law;
  • your handling of player, athlete, student, client or research participant information;
  • your coaching, training, research or professional decisions.

21. Governing law

These Terms are governed by the laws of New South Wales, Australia, unless mandatory law in your location requires otherwise. Courts in New South Wales, Australia have non-exclusive jurisdiction.

22. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of ForceMap after the updated Terms take effect means you accept the updated Terms.
